Do I Need Council Permits to Repave a Residential Driveway in Cape Town?

In most cases, repaving a driveway you already have doesn’t need City of Cape Town approval. But there’s one part of the job that almost always does, and it’s easy to miss: the crossing where your driveway meets the street.

When You Don’t Need a Permit

If you’re resurfacing an existing driveway, replacing worn pavers, fixing a sunken section, or upgrading from plain concrete to proper pavers and you’re staying within the same footprint on your own property, this is generally treated as maintenance rather than new construction, and doesn’t need a building plan or council sign-off.

When You Do Need Permission

The rule most homeowners don’t know about covers the strip where your driveway crosses the pavement (sidewalk) to reach the road. Under the City’s Streets, Public Places and the Prevention of Noise Nuisances By-law, no private crossing may be made or built in front of a property “except with the written permission of the City.” This applies if you’re:

  • Creating a new driveway entrance where there wasn’t one before
  • Widening an existing crossing (say, to fit a second car)
  • Moving your entrance to a different spot along your street frontage
  • Changing the kerb itself to lower or reshape it for vehicle access

If your project touches any of that, you need written permission before work starts, not just a courtesy heads-up afterwards.

Heritage Areas and Older Properties

If your property sits in a heritage-protected area, it’s worth checking with the City before you start, even for a straightforward resurface; heritage overlays can carry their own extra requirements that don’t apply to an ordinary suburb. It only takes a phone call to rule it in or out.

What This Looks Like in Practice

Most jobs we quote in Cape Town are exactly the kind that don’t need a permit: an existing driveway getting a proper re-lay. The exception comes up when a client wants to widen their entrance for a second vehicle, or a new-build needs its first crossing put in. In those cases, the crossing permission has to be sorted with the City before the kerb work happens; trying to do it after the fact usually means redoing work to match whatever the City requires.

Check Before You Book

If you’re not sure whether your project needs council sign-off, the safest step is to ask before getting quotes either through the City’s Development Management department or a contractor who’s dealt with the process before. A good paving contractor should be able to tell you within a few minutes of hearing your project whether a crossing permit applies.
